NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Cameron County.

REQUEST FOR RELEASE OF FUNDS

 

On or about June 27, 2025, the Cameron County will submit a request to the Texas Department of Agriculture for the release of Community Development Block Grant Program funds under Section 104 of Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as first-time water service in the Saldivar-Central Estates Colonia, CFC24-0004 for the purpose of Cameron County, Grant Recipient; has been awarded a $ 1 million dollar grant by the Texas Department of Agriculture, Texas Community Development Block Grant from Title 1 of the Housing & Community Development Act of 1974 as amended (42 U.S. C. Sect.5301 et seq.) to fund new sewer lines located in the BPUB-Brownsville Public Utilities Board service area.  The project area will include the Saldivar-Central Estates Colonia (03J) to address the need of lack of water service resulting in unsafe living conditions. Approximately 6,030 linear-feet of 8-inch PVC sewer line, 2,635 linear-feet of 15-inch PVC sewer line, manholes, tie-ins, de-watering, related street repair and all associated appurtenances improvements throughout Saldivar-Central Estates Colonia. The activities will benefit 197 persons, and 159 (80.71%) are LMI- Low to Moderate income.

The Saldivar-Central Estates Colonia will also include 14A activities to install first-time sewer service to 41 households, to include the decommission of 41 onsite sewage facilities (OSSF), related seeding, related street repair, yard lines & all associated appurtenances.  The TxCDBG funds shall not fund yard lines on private property to a household that does not qualify as LMI- Low to Moderate income status.  Grant Recipient will perform this work in the location(s) of Salida del Sol, Michelle Ave. & Central Ave.  Grant Recipient will ensure that all required engineering services are completed as required by state law, to include preliminary and final design plans, specifications, interim and final inspections and all relevant special services.  The Grant Recipient will ensure that all project related administration activities are completed, as described in the current TxCDBG Implementation Project Manual, and associated administration and/or engineering activities, for an estimated cost of $1,000,000.00 in HUD funds and $668,589.00 in non-HUD funds.  The project is located as follows: Saldivar – Central Estates Colonia.  Cameron County will communicate further with TDA Contract Manager/Environmental Specialist as needed on this project.

FINDING OF NO SIGNIFICANT IMPACT (FONSI)

 

Cameron County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Cameron County Dancy Building, 1100 E. Monroe St., Brownsville, TX 78520 and may be examined or copied on weekdays from 8:00 a.m. to 5:00 p.m.

PUBLIC COMMENTS

 

Any individual, group, or agency may submit written comments on the ERR to the Cameron County Community Services Department at community.services@co.cameron.tx.us.  All comments received by July 15, 2025, will be considered by Cameron County prior to authorizing submission of a request for release of funds.

Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

 

Cameron County certifies to the State of Texas that Eddie Treviño, Jr. in his capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Cameron County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

 

The State will accept objections to its release of fund and the Cameron County ’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Cameron County  (b) the Cameron County  has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Texas Department of Agriculture at CDBG_EnvReview@TexasAgriculture.gov or PO Box 12847, Austin, Texas 78711.  Potential objectors should contact the State to verify the actual last day of the objection period.
